Terms of Service: Moebius Connect App

Effective Date: August 1, 2026

These Terms of Service (“Terms”) govern your access to and use of the Moebius Connect mobile application (the “App”), provided by the Moebius Syndrome Foundation, a Colorado nonprofit corporation and 501(c)(3) organization (“MSF,” “we,” “our,” or “us”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. About the App
Moebius Connect provides educational content, community resources, and connection opportunities for individuals and families affected by Moebius syndrome. The App is provided free of charge as part of MSF’s charitable mission.

2. Eligibility and Use by Minors
The App is intended for use by individuals with Moebius syndrome, their families, caregivers, and members of the broader Moebius community, including minors who use the App under the supervision of a parent or guardian. If you are under 18, you should use the App together with a parent or guardian.

3. Acceptable Use
When using the App, you agree that you will not:
Use the App for any unlawful purpose or in violation of these Terms.
Submit false, misleading, abusive, or harassing content through any form, message, or feature within the App, including the “Contact Us to Collaborate” or “Suggest a Provider” features.
Attempt to interfere with, disrupt, or gain unauthorized access to the App or its underlying systems.
Impersonate any person or misrepresent your affiliation with any person or organization.
Use the App to collect or harvest personal information about other users.
We reserve the right to remove content or restrict access to the App for any user who violates these Terms.

4. Medical Disclaimer
The App provides general educational information about Moebius syndrome and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified physician or other healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or accessed through the App.
The App may include a directory or listing of healthcare providers. MSF does not endorse, recommend, or guarantee the qualifications, services, or outcomes of any provider listed. Any decision to seek care from a listed provider is made at your own discretion and is not a recommendation by MSF.

5. User-Submitted Content
Certain features of the App allow you to submit information, such as suggesting a healthcare provider or contacting MSF to collaborate on content. By submitting content through the App, you represent that the information is accurate to the best of your knowledge and you grant MSF permission to use, review, and, where appropriate, publish or share that content in connection with MSF’s mission. MSF reserves the right to decline to publish or act on any submitted content at its sole discretion.

6. Intellectual Property
The App, including its design, text, graphics, logos, and the Moebius Syndrome Foundation name and marks, is owned by MSF or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the App without MSF’s express written permission. 7. Third-Party Links and Services
The App may contain links to third-party websites, resources, or services, including research articles, external organizations, and social media platforms. MSF does not control and is not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of any third-party site or service is governed by that party’s own terms and privacy policy. The App is built and hosted using a third-party application development platform. That provider’s handling of data collected through the App is described in our Privacy Policy.

8. Privacy
Your use of the App is also governed by our Privacy Policy, available at https://www.moebiussyndrome.org/privacy-policy/, which describes how we collect, use, and protect information collected through the App and our other Services. By using the App, you agree to the practices described in our Privacy Policy.

9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MSF DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION PROVIDED THROUGH THE APP IS COMPLETE, ACCURATE, OR CURRENT.

10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MSF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF MSF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE APP IS PROVIDED FREE OF CHARGE AS PART OF MSF’S CHARITABLE MISSION, MSF’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED FIFTY DOLLARS ($50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification
You agree to indemnify and hold harmless MSF and its officers, directors, employees, and volunteers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the App.

12. Changes to the App and These Terms
We may modify, suspend, or discontinue the App, in whole or in part, at any time without notice. We may also update these Terms from time to time. Material changes will be reflected by a revised effective date at the top of this page and, where appropriate, communicated within the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Termination
We may suspend or terminate your access to the App at any time, for any reason, including if we believe you have violated these Terms.

14. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles, unless otherwise required by applicable law.
